§ 51.07. UTILITIES OUTSIDE THE TOWN.

  • (A) In the event that any utility owned and/or operated by the town shall be requested for any property that exists outside the corporate boundaries of the city, the owner must execute an agreement that so long as the real estate shall be connected to the utility the owner will not file or remonstrate against any proposed annexation of the real estate.
    (B) The agreement shall also contain a provision that the persons owning or occupying the real estate will agree for themselves, their executors, their administrators, their heirs, devisees, grantees, successors, and assigns from bidding them from objecting the annexation proceedings.
    (C) All agreements for utility hookup and annexation waiver shall be recorded with the Delaware County Recorder and made a part of the title of the real estate.
